Lawyer Says Auberger Agreed to Hire Pignato in Meeting

(Rochester, N.Y.) - Attorney John Parrinello says he was present at a meeting that draws the Greece supervisor into the criminal investigation of the town's police department and its chief.

Monroe County District Attorney Mike Green said if true, it would make Parrinello, the lawyer for suspended Police Chief Merritt Rahn, a material witness in the case against his own client

Parrinello said early in 2002 he arranged a meeting in his office on Main Street in Rochester.
In attendance were Gary Pignato and Greece Supervisor John Auberger.

Pignato was Parrinello's client when he sued the Rochester Police Department for firing him.


Parrinello said he watched Auberger turn to Pignato and say, "I'm going to hire you because John Parrinello says I should."

Pignato was eventually hired based on a false background check; Parrinello said the town supervisor was in on any deception.

In a written statement, Parrinello says Rahn never was involved in the background check. Even if his statements are true, that doesn't necessarily absolve Rahn of blame.


Suspended Sgt. Robert Trowbridge, who has been charged with filing that false report, said his orders came from Rahn.

Trowbridge's attorney Larry Kasperek said, "It raises questions over whether he was compelled or coerced into doing it; whether he was under some kind of threat or intimidation."

Parrinello, is on vacation out of town and did not provide any proof of these allegations. Critics say he has motivation to deflect blame from his client. Parrinello said he'll address all of this when he returns to Rochester on Monday.

Auberger Denies Knowledge
At a news conference on Tuesday, Auberger sidestepped the issue of whether he had any influence on the hiring process saying that "it requires the approval of the Town Board."

When asked, “Do you make a recommendation to the town board personally whether he should be hired or not?”  Auberger said, "The town supervisor does have a vote."

In a written statement, Parrinello says Merritt Rahn never was involved in the background check. 
A Greece spokesman said Auberger does not recall the any meeting with Parrinello and Pignato together.

Monroe County District Attorney Mike Green said, "If [Parrinello] has information he should come in and we'd be more than happy to send investigators and document everything he has to say and follow up on it...I don’t want to start wild speculation. We’re looking for any information we can get.”

Background
Pignato was recently sentenced to several years in prison after being convicted on charges that he coerced women into having sex with him.

The internal investigation of the Greece police department began due to questions surrounding the department’s actions surrounding Pignato and another former officer Nick Joseph, who was also recently sentenced to prison after being convicted of charges stemming from a hit-and-run accident in August 2008.

Green’s office is also investigating the background check done on Joseph. The Rochester Democrat and Chronicle reports that when Joseph left the Rochester Police Department, he was being disciplined for allegedly altering information on a search warrant.

Would someone put a muzzle on Parrinello. I'm personally sick of the guys big mouth. He represents the absolute filth Rochester has to offer. He also seems to have way too much power for being a dirtbag laywer. Please retire to Cuba and leave Rochester alone.

I agree with DH678, they should have an internal investigation on all agencies, like an audit. Maybe every 5 years. Most will come through with flying colors, others will have things found wrong with their policies and proceedures and should be given so many months to fix it or be fined. What a mess they have made, and they should all be ashamed of themselves. But like what RochesterWatch says, people are probably doing wrong all over, but until they get caught or an accident happens then they are unstoppable. I met Aughburger at a Firemens Banquet once, he was already half in the bag, and I was not impressed. We as a people sometimes look-up to the wrong kind of people- just remember in the grand scheme of things "WE ARE ALL JUST PEOPLE". Some of us people are good athletes, singer/performers, actors/actresses, but in the end we are just people that excel in a certain area. I like to see the best in people, until I am shown different.

RochesterWatch, I NEVER said they shouldn't be investigating. I was making the point that it most likely isn't just a Greece thing, like everyone seems to want to make it sound like, only highlighted because of the investigation going on.

"The only reason they are finding things in Greece is because they are investigating them. " - So what's your position, that we shouldn't be looking? They screwed up and opened the door. Now we get to see all the problems. That's always the way of things. You can drive around drunk your whole life, as long as you never speed or crash or drive irratically. But if you slip up and give them a reason to stop and check you out you're going to be screwed.

Hey! Looks like we have all found something we agree on here! And, I have to agree; let's open the books on all of the Police Agencies in Monroe County...seems to me that the nepostism and power brokering may have really gotten to a crisis level. Call in a special FEDERAL PROSECUTER to look into this matter. And, sorry Maggie, we may have to ditch the Performing Arts Money Pit to fund the whole operation. Like you said, "We brought the whole Dog and Pony show" to City Council last night; I want to see an investigation of all this nonsense that has been going on during your tenure. Stop trying to push your private sector favoring plan on the City, and fix all of the other things that are broken in your realm. Oh, right, you could start another Hot Line

Hellopeople, EXACTLY! The only reason they are finding things in Greece is because they are investigating them. If they were doing it everywhere else the results may not be that much different.

This is what the Dr ordered... Auberger needs to be held accountable for his actions. This whole scheme was cooked up to deflect from his own actions... Well Mr. Auberger, crossing your fingers and hoping for the best won’t work this time. Be good to see you on the other end of the mic.
