More Troubles for Greece PD as Investigation Widens; Pignato Hearing

(Greece, N.Y.) - The scope of the investigation into the Greece Police Department has grown significantly as, investigators say, they're now looking at "close to a dozen" areas of wrongdoing. 

Joe Loszynski, a retired deputy superintendent with the New York State Police, is heading the investigation.     

"We're looking at the department with a microscope right now,” he said.

Loszynski and the other investigators are examining pieces of documents allegedly shredded last month in an incident at police headquarters involving now suspended Chief Merritt Rahn; Deputy Chief William Mackin; and a sergeant Brian Ball.

Loszynski said, "It's a very tedious forensic effort when you're trying to piece together shredded paper residue from a shredder."

During the past year, two officers have faced criminal charges:

  • Former sergeant Nicholas Joseph was recently convicted for his involvement in a hit-and-run crash last year.

  • Suspended Officer Gary Pignato goes on trial Monday for charges of  bribery, coercion, and official misconduct (see related story below).

Investigators have interviewed Rahn, Pignato, and Joseph, and, although Loszynski wouldn't say if the three had answered all questions, they can be held for insubordination if they don’t fully cooperate.

Loszynski admitted he's also looking at Sergeant Tom Schammerhorn for his alleged role in letting a Rochester cop walk away from a suspected DWI. He said tips are rolling in from the community.

"I think at the end of the day, if I was a taxpayer here, I would feel much more comfortable if I went to bed at night in putting my head to the pillow in saying I have an ethical police department," Loszynski said.

Loszynski said the investigation is aimed at protecting the town from civil lawsuits and the integrity of criminal convictions. He says he hasn't yet found any evidence that could possibly overturn a criminal conviction, but he's in constant communication with the District Attorney's office and state police should anything he uncover warrant criminal charges.

He described the Greece Police Department as a whole as cooperative under Acting Chief of Police, Brian Urmacher. Under his leadership, there is an emerging attitude from the rank and file of wanting to get the department cleaned up.

ADA: Pignato "Used his Badge as a Dating Service”

(Rochester, N.Y.) -- At a hearing for suspended Greece Police Officer Gary Pignato, the Assistant District Attorney Bill Gargan presented statements from 12 Jane Does.

Prosecutors sought permission to use the complaints, dating back 12 years, as evidence in Pignato's upcoming sexual bribery trial.

With one exception, all the statements said they had professional contact with Officer Gary Pignato while he was on duty.

They each claimed he attempted to pursue them. Gargan said Pignato used his badge as "a dating service."

In her statement, one Jane Doe said she met Pignato at a funeral where he was working as an officer with the Palmyra Police Department.

She said he followed her home uninvited. He pushed her onto the sofa and allegedly told her the fastest way to get over her grief was to have sex. She said she didn't want to but felt pressured because he was a cop.

Defense attorney Scott Green said, nothing has been done to validate the truth of any of the women's accounts, and, if the statements are true, these are flirtations that might make Pignato “a cad, but not criminal.”

Jane Doe #7

Jane Doe #7 says after ignoring his sexual advances Pignato walked through her sliding glass door, caught her smoking marijuana and threatened to arrest her.
 
She said she agreed to meet him later and after he did a line of cocaine, she said they had rough, forceful sex.

That case led to another indictment on four charges for Pignato.  A judge ruled that case can be used as evidence in his upcoming bribery trial which begins Monday.

Prosecutors want to show a pattern of behavior to prove Pignato's intent the night he allegedly accepted sex as a bribe.

Media/Public Allowed In
Before the hearing, 13 WHAM News successfully argued to keep the hearing open to the public and media.

Green said that even though 11 of the allegations won't be allowed as evidence in the trial, they will be broadcast anyway which is why he wanted the hearing closed.

Pignato is now charged with coercion, bribery, official misconduct, and criminal trespass.

The trial begins Monday.

To Crusader from 5/29 I'm not trying to be a smart a-s nor am I trying to say that improper behavior, or bad judgement wasn't used, but I do have to correct you when you use the word RAPE. These women were not and I repeat not RAPED. They went to meet him on their own accord. Nobody forced them to meet him, nor were they forced into his hot tub or bed. Please lets keep that straight. The way I see it is that these women were not to bright, believing that just because he was a police officer that he could just make things happen. There's much more involved, it's not quite that simple to talk smack about someone doing improper things and have someone's children away. I do believe that anyone with a little smart's would know that. Being a police officer doesn't make him or anyone else God. No disrespect intended.

I HAVE KNOW GARY FOR MANY YEARS, DON'T THINK HE ACTED THIS WAY BECAUSE OF THE VOWEL IN HIS LAST NAME. HE MIGHT HAVE NOT MAD THE RIGHT CHOICES OF WHAT HE HAS DONE. BUT LETS LOOK AT THE PIGS THAT HE WAS DOING IT WITH. IF HE WAS SUCH A PROBLEM WHY DIDN'T ONE OF THESE UPSTANDING GIRLS DO SOMETHING ABOUT IT. WHY WAIT UNTIL THE BOYFRIEND CAUGHT HER TO SPEAK UP. Thereare soom great officers in greece (Gabe DiPaola, Joe Capeta )they are some of the ones that pay for the bad ones they started in greece and grew up in greece maybe that what makes the differeance.if they want a chief that will be on the up and up put Gabe DiPaola in that position he will straiten it out

The courts need to do their thing, because that's the way (thankfully) it works (in theory) in the US. That said, there is absolutely no doubt that this scumbag is guilty. And there is little doubt that many of his fellow officers had to know about him. Is the entire GPD crooked? No, that seems unlikely, but it's a lot more than the "few bad apples" we hear talked about. A large percentage of the force must have minimally been willing to look the other way. I'd expect more principled behaviour from people entrusted with that authority.

Hopefully he not before Judge Affronti. Affronti gives special treatment to police officers. Like, 1 year for a drunk officer high on coc hitting a pregnant woman while do 70 mph, then leaving the scene and leaving the vic and her unborn baby with best of luck on the roadside. So, 12 counts of stalking & rape should only be 6 months jail for a cop.

While shopping in a Greece Wegman's, I saw a rather large guy with a T-shirt on. On the back of the shirt was printed: (para phrase) Real Cops work the city. Way to go Officer.

Thank you, concerned. And please, I don’t want anyone to think that I agree with what Mr. Pignato has done, I am just saying I don’t think that he did it because his last name ends in a vowel. That’s like saying the entire Greece police dept is corrupt – I’m sure there are plenty of decent men and women who work for the Greece Police Dept. who are just sickened by all of this.
