(Rochester, N.Y.) - According to evidence submitted in court Monday, a Greece Police officer was speeding when he slammed into a stalled car on Route 390.
Officer Nick Joseph is on trial for leaving the scene of the crash. The woman in the car that was hit was forced to deliver her baby prematurely.
Last week, prosecutors said surveillance tape from inside a Rochester bar proves Joseph was served seven drinks in an hour's time.
The tapes from Spenders bar on Lyell Avenue clearly show Nick Joseph, wearing a white shirt, receiving the equivalent of seven shots of alcohol in a span of 53 minutes.
One piece of video shows the bartender giving what she described in court as a "generous pour" of hard alcohol. Joseph then takes the drink, walks around a bit, and then drinks at least some of it.
However, the video doesn't show Joseph chugging alcohol or fully consuming all seven shots.
The prosecution contends that the video is evidence enough that Joseph received drinks and that it would be "silly" to think that he didn't consume them.
The defense says the tape is evidence that Joseph was walking around the bar, not stumbling.
