Man Gets Maximum Sentence In Deadly DWI

Rochester/Parma, N.Y. - A licensed chiropractor was sentenced Wednesday to 5 to 15 years in state prison for a DWI crash that killed two people.

Stephen DiVito pleaded guilty last October to vehicular manslaughter, vehicular assault and driving while intoxicated in a deadly crash in November 2011.

Patricia and James DePinto were both killed in that crash.

DiVito was also sentenced to 5 years of probation and will lose his driver's license for 5 years post release.

The victims' family spoke at the sentencing, asking how the chiropractor could leave the scene of the crash.

"The scene never leaves my mind," the victims' daughter said. "DiVito is a trained medical professional and he would not even stop to help."

DiVito apologized at sentencing. "I am haunted by what I did, but I know that is insignificant compared to the pain I caused your family," he said.
