That officer was carrying his gun according to standard operating procedures. Never would a police officer off duty or onduty keep the safety on his or her gun...

The more important question is why an off-duty policeman was carrying a gun that was loaded and had the safety disengaged. You can call this an accident if you like, but the officer set the situation up by his negligent handling of his firearm.

Although I don't know why he had his weapon on him while he was off duty, this woman's death as a result of it accidently discharging is just that--an accident. Unless he was illegally carrying his weapon, I cannot see why any charges should be filed....sadly, accidents do happen & blamimg someone or suing them cannot change the outcome. My condolences to this woman's family & friends.
