Rochester, N.Y. - 31-year-old Jackie Walker of Fairport is in stable condition after being shot at Gitsis Restaurant on Monroe Avenue. It happened around 3:15 a.m. Sunday.
Police have also identified the alleged gunman.
Rochester Police say officers were approached by security at the restaurant who told them a man, 30-year-old James Harvey of Virginia Beach, had a gun inside the restaurant.
13WHAM News spoke with two witnesses who were inside Gitsis at the time of the shooting.
Neither of the witnesses wanted to be identified.
One shared cell phone video with us.
“We're sitting in the booth and we heard a loud pop and immediately people began to scramble and duck underneath the booth and run for whatever exit they saw,” recounts one witness.
“I think a lot of people realized it was gunshots and started screaming and running to the other side of the restaurant or tried to get out the front,” another witness said.
The witnesses sat one booth away from the gunman.
They described a scene so chaotic they didn't even see the woman who was shot, but say they did see an RPD officer who was in the back of the restaurant when the shot was fired.
“There was a cop in the back who was up to the scene within ten seconds, handcuffing the suspect,” the witness said.
We’re told people fought with police as they tried to clear the scene.
This isn't the first incident at Gitsis or other late-night eateries along Monroe Avenue.
In 2008, Mark’s Texas Hots was robbed.
In 2000, a Gitsis employee was shot in the restaurant, and in the summer of 2012, three men were charged with gang assault after a fight in the Gitsis parking lot.
Director of the Rochester Business Association, Alex White says he worries these types of incidents will lead to consequences.
“Our fear, as always, is that the city will use this as an excuse to restrict hours and close business and I don't think that's a solution,” White said.
Police haven’t said whether the suspect knew the victim.
The suspect and victims' names have not yet been released.
The 31-year-old Fairport victim is in stable condition.
The owner of Gitsis was unavailable for comment.
