Rochester, N.Y. -- Injured Rochester Police Officer Anthony DiPonzio will testify at the trial of the 15-year -old charged in his shooting.
Tyquan Rivera appeared in Monroe County Court Wednesday, but the case was adjourned because his attorney is ill.
However, a judge denied a request to dismiss the charges against Rivera, who faces charges of second-degree attempted murder and first-degree assault.
Monroe County District Attorney Mike Green says he is not worried about publicity in this case affecting jury selection in Rivera’s trial, which is scheduled for August 10.
"We’ve had other cases that have received as much or more publicity. It’s something we’ll deal with," Green said.
Rivera will return to court June 10, and he has agreed to let a new attorney handle that court appearance, which will include testimony from police and neighbors who identified Rivera as a possible suspect in the shooting.
Tyquan Rivera remains in custody in the children’s shelter without bail .
