Business Owner Accused Of Raping 14 Year-Old Employee

Henrietta, N.Y. --- An indictment unsealed in Monroe County Court Tuesday morning accused Taha Alashwal, 34, of sex crimes related to the rape of a 14 year-old boy.

Alashwal faces one charge each of Criminal Sexual Act 1st Degree and 2nd Degree. 

The crimes reportedly occurred at a Henrietta hotel on June 20th and the victim told police that he was forcibly raped after spending about twenty minutes in a hotel room jacuzzi with Alashwal. 

The victim told police investigators that during one of the alleged acts he “saw a pen on the bed side table and I reached for it and then pulled the cap off of the pen and then stabbed him in the back of the neck.”

Court records show that Monroe County Sheriff’s Office Deputies investigating the crime inspected the back of Alashwal’s neck and observed “a small round hole that appeared to have blood in it…it seemed to be consistent with what (victim) reported.”

The victim then describes fleeing the room and running towards the hotel lobby where he alerted employees who called police.  While waiting in that lobby the boy states he had another encounter with Alashwal and that he, “told me he would pay me $5,000 if I didn’t say anything. He said think about (it) and I didn’t reply.”

Authoriteis and Alashwal's lawyer described him as the owner of a Rochester area restaurant called Mojo’s on Genesee Street.  (Note: Public records list the restaurant as being in someone else's name, he is the owner of a restaurant in the Syracuse area.) 

The victim tells police that Alashwal hired him to go door-to-door handing out menus and that he later moved up to dishwashing and breading chicken wings. 

Assistant District Attorney Kyle Rossi tells 13WHAM News that the evidence suggests that Alashwal offered this boy gifts, a job, and privileges that he would not have otherwise had access to.

"This is a child who comes from a great family but of limited means and the boy became more and more attracted to the store and of course this particular person and that led to this incident which was not what the boy had anticipated," Rossi said following Alashwal’s arraignment.

Alashwal, who lives in Onondaga County where he owns a similar restaurant, is also facing similar charges in that county that date back to an alleged incident in 2006 involving a 15 year-old boy.  Late Tuesday Rick Trunfio, the First Chief Assistant District Attorney for Onondaga County, confirmed that his office was in the process of agreeing to a plea deal with Alashwal when they learned about the charges in Monroe County.  That office withdrew the plea offer and is now presenting evidence to a grand jury.

A.D.A. Rossi said that he sees similarities in the two criminal cases based on what little he knows about the allegations pending against Alashwal in Onondaga County.

“We're always concerned about that,” Rossi replied when asked if he suspects more potential victims could be out there.  “And I would say it's a high concern in this case; he is innocent until proven guilty, he will have his day in court.”

"He's got a wife and kids, he owns two businesses, no prior criminal record so I don't know the history of who this complainant is (or) if this complainant has any issues with my client at this point in time we don't know," Alashwal’s lawyer Matthew Parrinello said Tuesday while reiterating that his client denies these charges.

Alashwal posted $25,000 cash bail and is living with his wife and three children in the Syracuse area.  Judge Francis Affronti is requiring Alashwal to remain in Monroe or Onondaga County at all times and an order of protection for the victim was signed in court on Tuesday.

A.D.A. Rossi said the victim and his family have moved out of the area following this incident.  He described him as a "Straight A" student and a "scholar athlete" who was competing at a high level in sports considering his young age.
