Batavia, N.Y. --- After considering the case against her a Batavia City Court Judge and the Genesee County District Attorney's Office agrees to drop a criminal trespass charge against Nicole Lang.
So long as she is not arrested again in the next six months Lang's arrest will be dismissed in the interest of justice.
"I've never even had a parking ticket before," Nicole Lang said of the nerves she felt in court.
Lang was arrested in July after she confronted staff at the 420 Emporium on Ellicott Street in Batavia. She admits demanding that the store stop selling bath salts to her son Jason. An employee chose to press charges after Lang re-entered the store after she was told to leave.
Lang's son Jason has encountered a series of legal problems in recent months while battling an addiction to bath salts according to him and his family. Last month Lang and his mother both told 13WHAM News in separate interviews that he was struggling with bath salt use.
