North Rose, N.Y. - Wayne County Sheriff's Deputies arrested a man they say shot his neighbor's dog.

Brian Barnes, 50, is charged with aggravated cruelty to animals and discharging a firearm within 500 feet of a dwelling.

Barnes told deputies he shot the animal near his York Settlement Road home in defense of himself and his dogs. Investigators, however, say they determined that at the time of the shooting, the wounded dog was in retreat.

The animal was treated at Sodus Veterinary Hospital, and then transferred to an animal hospital in Rochester.

There's no word on the wounded dog's condition.
