Parents Charged For Not Protecting Child From Sex Offender

Investigation Continues Following Kroll’s Arrest

Court documents on file in Brighton Town Court reference a videotaped interview with the boy that took place in Batavia on July 30th.  In that interview law enforcement reports that the boy stated Jay Kroll performed sexual acts with him “at least a hundred times” and the boy also identified a series of sexual images “taken of him by Jay Kroll.”

The boy told authorities that he, “didn’t know (Jay Kroll) had a record eighteen years ago, my parents didn’t tell me.  I didn’t know what to do, so I went along.”

Authorities report that the boy also told them he never told his parents about the abuse, “but they never asked.”  When asked about Kroll’s status as a registered sex offender the boy told authorities in this interview that, “it would have been good to know.”

Police wrote in court documents that the boy’s father was heard saying after this interview, “I failed to protect my child.”

An official at the boy’s school also submitted a statement dated September 12, 2012 that relays information about a phone conversation she reportedly had with the boy’s mother.  She said that the mother acknowledged she knew of Jay Kroll’s criminal past but that she didn’t suspect her son was abused because her husband was a federal law enforcement agent and Jay Kroll “knows my husband would kill him.”

A signed statement from a Brighton Police Investigators dated September 4, 2012 detailed a conversation had with the boy’s father.  “(Dad) stated that he knew that Jay Kroll was a sex offender from a long time ago but did not know what the levels meant.  (Dad) stated that he was unaware of the laws and restrictions involving sex offenders.”

Status Of The Charges Against Parents

The father was arraigned Monday and pled not guilty.  The mother is scheduled to be arraigned next week and is expected to enter a not guilty plea.  Endangering the Welfare of a Child is a Misdemeanor charge that carries a maximum penalty of one year in jail if convicted.

Brighton Police Chief Mark Henderson said in a statement that these charges come “after completing a 10 month investigation into the actions of Registered Level 2 Sex Offender Jay Kroll, and upon consultation with Monroe County District Attorney Sandra Doorley and members of her staff.”  Chief Henderson added that he will “defer all questions to the Monroe County District Attorney’s Office.”

A spokesman for Monroe County District Attorney Sandra Doorley is working on a response to multiple questions submitted by 13WHAM News.
