Brighton, N.Y. --- The parents of a sexual abuse victim are now facing criminal charges for failing to protect their child from his alleged abuser.
The alleged abuser is Jay Kroll, 56, is a Level 2 Registered Sex Offender in the State of New York and also a relative of the boy he allegedly abused. Kroll lives in Long Island but was living temporarily in the Rochester area last year.
The boy’s parents, according to police, failed “to exercise reasonable diligence to protect” their 13 year-old son “from becoming a sexually abused child.” The court paperwork for this charge goes onto state that the parents “failed by knowing and not telling (their son) that (Jay Kroll) was a registered level two sex offender.” The parents are accused of allowing their son “to be alone with Jay Kroll on numerous occasions and for long periods of time.”
While the names of the parents and other key facts and relationships are identified in public court documents 13WHAM News is taking extraordinary steps to protect the identity of the child. At this time, we are not naming the parents nor identifying the family relationship Jay Kroll has with the child.
We are stating that the father of the child is a federal law enforcement officer.
The lawyer for these parents, Robert Napier, tells 13WHAM News that he expects his clients to be fully exonerated and that they maintain their innocence. Napier said a senior caseworker for Child Protective Services stated in a safety assessment report during this investigation that, “the child remains safe in the care of his parents at this time.”
Napier said that during the father’s arraignment Monday night a Brighton Town Court Judge did not think an order of protection against the parents was appropriate.
He said his clients just want privacy to help heal their family and these criminal charges stand in the way of that.
