Livingston Co., N.Y. – The district attorney's primary race in Livingston County is no longer a tie.

In court Wednesday, State Supreme Court Judge John Ark reviewed seven questionable absentee ballots cast in the Republican Primary between Steven Sessler and Eric Schiener.

The Board of Elections says the recount puts Schiener up by one vote.

Judge Ark has reserved decision on the ballots in dispute.
