Toxicologist: Joseph's BAC Could Have Been Twice the Legal Limit

(Rochester, N.Y.)-A toxicologist determined that if Nick Joseph drank as much alcohol as is believed, his BAC could have been almost twice the legal limit on the night of a hit and run accident..

Video from Spenders Bar on Lyell Avenue shows Joseph being served the equivalent of seven shots of alcohol in a span of 53 minutes.

The chief toxicologist for the Monroe County Medical Examiner’s office determined that given his height and weight, his blood alcohol content (BAC) would range from just over the legal limit to nearly twice the legal limit.

But the video does not show Joseph guzzling the drinks or even finishing the drinks. So the judge did not allow the BAC level into evidence.

Dr. Jean Beano analyzed blood samples taken from the airbag of the Ford Fusion Nick Joseph was driving. She concluded the traces of cocaine found there had been metabolized into his blood and were likely ingested within an hour of the time he struck Alexis Sharp’s car.

But defense attorneys take issue with the findings. They point to cocaine residue on parts of the airbag without blood. The car was not properly impounded for at least three days after the crash. They point out that cocaine could have been put there by someone else.

The points will be further discussed in court as the trial continues.

Nick Joseph is accused of hitting Alexis Sharp’s car in June 2008, and causing her to deliver her baby 14 weeks early.

again-why didn't the police track down the owner of the vehicle the night it happened? They had the plates, the reg, the info in the glovebox...because they knew whose it was, am i right? why didn't they go over to his house? If someone doesn't sue or arrest more people in this botched cover-up i'll be surprised!

exactly!! and that's probably why joseph went back to his car, to get the cocaine baggies out!!

The lab determned that the cocaine was metabolized in the blood. Nobody snuck into to the lot and sprinkled coke on his airbag. Now, there may have been unmetabolized coke thoughout the vehicle, but that's a different issue. It probably went flying around in the collision, but I suppose you could argue it was placed there after the fact. But not the stuff in the blood.

how is what this "cop" did any less-serious than the guy who was high on coke and killed those 2 young boys? I mean the results are different, but this "cop" injured a young mother, and possibly injured for life her baby! Then he walked away and said he doesn't remember. But he remembered enuf to call his wife, and to call his "cop" buddy pignato.

who else could have put the cocaine there? where their any other finger prints found? what a stupid defense! why doesn't this guy just accept it-he screwed up big time. and he's probably been using drugs for quite awhile!! look where he was...lyell ave. a known coke bar. by himself!!! and he's married!!!

here are some questions i would ask: (if anyone can answer, please do)1. why didn't the police go to the house the car was registered to THAT NIGHT? 2. Didn't earlier reports saw the camers saw this cocaine-cop at the marriot inn? 3. Why was he given access to his car (evidence) 4. Do the greece police handle all evidence like this? 5. did anyone else hear the lawyers voice rise up 3 octobels when stating he didn't know where the cocaine came from? a sign of deceit!!! why hasn't the person who drove him home come forward, because they know it's a crime? why didn't they get the phone records?

Not a exact science. But with the other article about "Rethinking Drinking" It would be a open and shut case.
