Victor, N.Y. – 31 year old Ryan Whidden appeared disheveled Thursday as he was brought into Victor Town Court in handcuffs.

He remains in the Ontario County Jail on 250-thousand dollars cash bail.

When reporters asked Whidden if he had any comment, he first responded:  "I am not allowed to speak to you."

Then leaving court he added: " I am sorry I can't speak here, we'll have our chance later, I guess."

A judge delayed the preliminary hearing scheduled for Thursday until March 22nd.

The judge also indicated a grand jury could hear evidence in this case.

Ontario County Sheriff Phil Povero told 13WHAM News earlier in the week that a grand jury could consider other charges including Unlawful Imprisonment.

Sheriff Povero said Whidden held his wife hostage in a closet of the home during the stand off with police, using her as a shield as he fired shots out the closet door and out a window.

Police never returned fire, but used tear gas to get Whidden out of the house.

They said his wife Nina was not hurt.

Whidden is charged with Criminal Possession of A Weapon. Police say the pistol he used was not registered in New York State.

Ontario County Sheriff’s deputies said a man called 911 around 9:20 a.m. Monday when he saw Whidden come out of his home on Ketchum Street and shoot a gun at two of his own cars in his driveway. There was no one inside those cars.

Police said Whidden then barricaded himself and his wife in a first-floor bedroom closet.

Whidden's attorney, Leanne Lapp, had no comment on the case.

He is scheduled to be back in Victor Town Court next Friday at 11 a.m.
