Baby Left Home Alone, Mother Charged With DWI

Gorham, N.Y. – Ontario County Undersheriff David Tillman says "it was a dangerous situation."

Vanessa Rosa, 21, was observed swerving all over Route 364 and at times, crossing the center line.  The deputy who stopped her just before 1 a.m., reported smelling alcohol on her breath.

Vanessa admitted to police, she drank two beers before leaving her house.
Then she also admitted, leaving her 15-month-old daughter home alone.

Canandaigua Police sent officers to the house, the baby was fine and the child's father had just arrived home.

The toddler was left in the care of her father.

Meanwhile police say, Vanessa Rosa, became violent. She failed field sobriety tests and refused a Breathalyzer.

Police say she kicked the deputy as he tried to arrest her. She also banged her head against the cage in the squad car until her head and face bled.

Police say she spit blood in the deputy's face. And then once at jail, spit blood at a second deputy while she was being booked on the charges.

That act alone is a felony, Aggravated Harrassment. Rosa is also charged with DWI, Endangering the Welfare of a Child, Resisting Arrest and Assault.

She is being held in jail. Bail is set at $10,000.

We spoke to the baby's grandparents and to Vanessa's husband Kyle. They say Kyle had no idea the baby was left home alone.

Kyle's parents tell us the couple is separated and "having problems."  After this happened, they say Kyle went to Family Court and was awarded temporary, full custody of their daughter.

Vanessa Rosa is due back in Canandaigua City Court Friday.
