Woman Charged With DWI - Son Called 911

Rushville, N.Y. - A 47-year-old woman is charged with DWI under Leandra's Law.

The Ontario County Sheriff's Office said Laura Mincer was driving with two boys in the car in the town of Gorham.

Mincer's 15-year-old son called 911 after being concerned about her driving, which led to an argument. 

That's when police say Mincer pulled her vehicle partially off the road on County Road 1 in the town of Gorham, leaving her son in the car.

A short time later, Mincer was found at her home about a mile away from where she left her car.

Mincer failed several sobriety tests and her B.A.C was greater than .18.

Even though Mincer was not caught driving in her car, police say she still can be charged.

"Based on the investigation and based on statements they received from witnesses, statements from her and basically any evidence they found at the scene, is how they based her arrest on,” said Sgt. David Frasca with the Ontario County Sheriff’s Department.

13WHAM spoke with Mincer at her home Wednesday afternoon, she didn’t comment on the allegations.

Mincer was also charged with open container and failure to keep right.

Her son is staying with his father.

She’s scheduled to appear in court at a later date.

She faces two counts of felony DWI Leandra’s Law.

She could face up to four years in jail and fines.

Its amazing that instead of thinking, "Wow, it's absurd that a mother decided to drive her son while she was drunk... good for the boy for calling, etc," the semantics of the article are debated. Good job.

I agree 100% with both comments from the person "srmsrm". Being that these are journalist writting the articles, one would think to have the articles proof read prior to being plublished. This I find quite often in my reading of the articles and it gets pretty annoying at times. I like the "driving a 15yr. old home" catch. That was a good laugh. LMAO, ROTF.

While I appreciate the updated report, I am amazed by the extremely poor sentence structure throughout the entire article. I'm not a teacher, but I feel like printing it out, making corrections and sending it back to be rewritten. - Also, I'm having trouble believing that the statement in quotation marks was really a direct quote from the officer. Did he really say that? I expect more from a journalism website.

When I read she was "driving a 15 yr old home", I immediately wondered how a home could be driven...
