Woman to File Against Pignato, Police, Alleging Forced Sex, Assault

(Rochester/Greece, N.Y.) -- The woman at the center of a bribery case involving a Greece Police officer has filed notice she intends to sue Officer Gary Pignato and the Greece Police Department.

The woman said she’s the victim of assault and battery that includes forced sexual contact. 
  
Police said Pignato responded to a domestic dispute call at the home the alleged victim shares with her boyfriend on August 24. The victim said he was with another officer, but was the only one to get out of the car.

According to court papers, Pignato asked her two questions: Had she been drinking? and, was she on probation?  She answered "yes" to both questions.

The victim said Piganto then informed her that being drunk was a violation of her probation and to stay out of jail she had to agree to meet him after his shift. 

She said she agreed because she believed she'd be arrested if she didn't.


After they met at a Mini Mart on McCall Road, the victim says Pignato then took her to his home.

According to her written complaint, she was subjected to "escalating sexual contact which eventually resulted in multiple acts of sexual intercourse and sodomy."

Pignato turned himself over to state police after being indicted for accepting a bribe and other charges.
 
Prosecutors allege that the bribe was not money, but sexual favors.
Yet, the victim calls it assault and battery.
 
She says Pignato used his authority and power as a police officer to force her to submit to sex acts.


The victim says she suffered mental and physical injuries. She was on probation for petit larceny of property valued at less than $50.

She is also suing the Greece Police Department alleging Pignato used his status as a police officer to intimidate the victim.

Pignato has already been indicted on three counts related to this incident. However, State Police have been interviewing other women who also say Pignato acted inappropriately on traffic stops.

What if they made arrangements to meet when he was off work and she was all for it? This was hours after she could have been arrested. Why didn’t she tell someone then and catch him red handed? So now they meet and do what ever. Her boyfriend finds out and is pissed. She doesn’t want to be in that situation so she says she was forced into it and was raped. She can’t go back on her word now so she might just as well follow up with trying to get as much money as she can. Why would she wait so long? This will send a message to all cops. I know they don’t want to arrest everyone they come in contact with, but I’ll bet they do now just to cover their a$$. It will be interesting to see how this turns out.

Yes he opened the door and is being charged and hopefully will be convicted to the fullest extent of the law. All I am saying is that all this sueing that is always going on needs to stop. I am sure it wasn't her idea to sue. Can you say Ambulance chasers.

The sueing nonsense he brought on himself. Do you think she wouldn't sue if she smelled a money source? She is probably thinking already what to do with the money. Not sure I agree with it but he did open that door now didn't he?

I too do agree his job was to uphold the law and he took advantage of his position. He is being charged for that. Let's just stop all this sueing nonsense.

whaler one - I am with you. He was a cop and his job was to uphold the law. Instead he took advantage of his position. Doesn't matter what she did.

DJ, your not going to believe this but Im going the other way. Cop has all the power, the chic has none. My take is that if she had no issues doing the do she wouldnt have made the call to the higher ups. I think it took courage for her to make that call and that if it was consensual she wouldnt have done it. Im going to take some heat for this position but I think she is real, I think she was wronged and I actually agree with CR and think it is rape at some level. I dont think her sobriety or criminal status have anything to do with her having rights as an individual. I think to the contrary they have everything to do with the cop taking advantage of her. Fire away all I probably have it coming but thats how I feel!
