Batavia, N.Y.-  A Batavia woman convicted of punching a 70-year-old Walmart cashier last Christmas Eve could be out on bail soon.

Jacquetta Simmons was sentenced earlier this month to six years in prison for assaulting Grace Suozzi.

Her attorneys argue her sentence was overly harsh.

On Friday, New York State Supreme Court Justice in the Appellate division, Rose Sconiers issued a stay of Simmons’ prison term, pending an appeal of her sentence.

Simmons can be released from prison on either $50,000 cash bail or $50,000 bond.

Her attorneys have until May to present their case.
