Son Accused of Beating Elderly Mother

Rochester, N.Y. --- "If he could do it to his mom he could do it to anybody,” a Hillcrest Street neighbor said Monday when asked about the brutal attack investigated on her block last Wednesday.

Derrick Stubbs, 46, of Rochester is charged with 1st Degree Assault.  Police believe Stubbs lived at the Hillcrest Street home with his mom.  He pled not guilty at his arraignment Monday morning and is currently being held in the Monroe County Jail without bail.

The neighbor who knows Stubbs’ mother did not want to be identified out of fear for retaliation.  Stubbs wasn’t arrested until Saturday morning when Rochester Police located him outside a nearby Wilson Farms on N. Goodman Street.

"Very scary, very scary, no sleep,” this neighbor said of the nearly three-days it took police to find Stubbs.  “Looking out our windows trying to catch somebody like this because if he can do it to his mom he can do it to anybody; he has no heart."

Court documents include a statement from the victim who reportedly told police that she was asleep in bed when the attack started.

“I was woken up by him putting something over my head and he started (to) hit me on my head," the victim’s statement read.  She claims the attack lasted ten minutes and that she “…just stopped moving, I was playing like I was dead in my bed and that's when the attack stopped."

"I mean she was left for dead," her neighbor said.

Also spelled out in court documents is how the victim managed to get herself help after hearing the suspect, who she identifies as her son Derrick Stubbs, leave the home.  She told police her phones were disconnected and that she made her way to the kitchen where she set a small fire on the stove to activate the smoke alarm linked to her home’s security system.  The alarm brought firefighters and medics who also gave statements to police.

In the court documents it explains that Ms. Stubbs was treated at Rochester General Hospital and received 59 stitches to her head.  Rochester Police Department spokesman Stephen Scott said she has been released from the hospital.  In a statement issued Monday Scott added, “It’s a horrific crime and our hearts go out to Ms. Stubbs and her family.  We wish her well as she recovers from her injuries.”

"I want him behind bars for the rest of his life because God knows if he gets out, he's going to do it again,” the unidentified neighbor added.  “If he can do it once he'll do it twice, three times and we don't need to be all scared in our own communities, in our own homes, that's just not right."

Monroe County District Attorney Sandra Doorley also weighed in on this case and explained that her team has been working with the victim since before Stubbs’ arrest.  This month Doorley announced the creation of a new Elder Abuse Bureau within a newly designed Special Victims Trial Division.

Statement by Monroe County District Attorney Sandra Doorley on the arraignment of Derrick Stubbs on the charge of Assault in the First Degree in Rochester City Court:

“The allegations against Derrick Stubbs are horrific.  If proven guilty of this conduct, he must be held accountable.

The newly created Special Victims Trial Division includes within it an Elder Abuse Bureau specifically designed to handle cases such as this, because unfortunately crimes against the elderly are far too common.  The criminal justice system is rightly focused on prosecuting criminals, but because of our Elder Abuse Bureau, we are able to better collaborate with organizations such as Lifespan to work with victims on an ongoing basis to secure the support and services they need.

In this particular case, the Monroe County District Attorney’s Elder Abuse Prosecutor Monica O’Brien, the Monroe County District Attorney’s Office Victim Witness Bureau, and Lifespan have been working together since before Stubbs was even arrested to coordinate the prosecution as well as to ensure that necessary services are made available to the victim.”
