Penfield, N.Y.- Monroe County Sheriff's Deputies say the motorcyclist who hit a bicyclist on Route 250 in Penfield Sunday has been charged with manslaughter.
Mark Scerbo II, 22, was arraigned from his hospital room Monday afternoon.
Police say Scerbo was riding his motorcycle behind his girlfriend's SUV on Sunday popping wheelies.
Police say when he tried to pass his girlfriend on the road’s shoulder, he hit Fairport School teacher Heather Boyum with his motorcycle.
Boyum was thrown from her bike, onto the road.
Police say Scerbo's girlfriend, 23-year-old Megan Merkel ran over Boyum with her car.
Boyum was pronounced dead at the hospital.
Authorities say Scerbo was riding his motorcycle recklessly, speeding and slowing down and doing wheelies at the time of the crash.
Merkel was arrested for DWI.
Scerbo has been released from Strong Memorial Hospital, and transferred to the Monroe County Jail.
Court records show that Scerbo was convicted of DWI three times since 2006.
Records show neither Scerbo nor Merkel had a driver's license at the time of Sunday’s crash.
