No evidence to support judge's claim

Waterloo, N.Y. -- Waterloo Police say there is no credible evidence to support a judges claim he was hit over the head with a porcelain toilet tank top.

Justice Roger Barto told investigators he was leaving court around 10:15 p.m. August 31, 2013, when a person tried to strangle him, then hit him over the head and neck area with a toilet tank cover.

However, after an investigation by the Village of Waterloo Police Department, the New York State Police, the Seneca County District Attorney's Office and other State agencies with the assistance of expert medical authorities, no truth could be found in connection with the claim.

According to a release from Waterloo Police, Barto stopped cooperating with the investigation.
