Whittemore trial to begin Monday

Rochester, N.Y. -- After several delays, jury selection in the trial of a man accused of murdering his girlfriend at the College at Brockport is scheduled to begin Monday.

Clayton Whittemore, 22, is accused of killing Alexandra Kogut of New Hartford, Oneida County, in her dorm room Sept. 29, 2012. He faces second-degree murder charges in her death.

Prosecutors said Whittemore beat Kogut, 18, to death with a curling iron and his fists during an argument. He was arrested later that day at a Thruway rest stop outside Syracuse.

Whittemore's attorneys will try to prove that their client suffered extreme emotional distress at the time of Kogut's death, which could allow for a conviction on a lesser charge.

Earlier this year, a judge ruled that incriminating statements Whittemore made to police about Kogut's death, in which he said he "snapped" and asked if he could seek the death penalty, could be used.

Whittemore faces 25 years to life in prison if convicted.
