A new lawsuit for the Medley Centre

Irondequoit, N.Y. A new legal battle is brewing between the owner of the Medley Centre Mall and local governments.

Bersin Properties, controlled by Scott Congel, is suing Monroe County, the Town of Irondequoit, the East Irondequoit school district and COMIDA, the Countys Industrial Development Agency.

The legal fight is over about $4 million in penalty payments for failing to develop the Medley Centre.

The local governments involved in the case are the same ones that want to end the tax break deal they signed with Congel seven years ago.

They say he failed to meet certain investment goals at the property. They say the deal specifically spells out the penalty payments that are owed if that does not happen.

Some residents around Irondequoit spoke to 13WHAM News about the lawsuit.

Hes been given tax credits and Im sure help with acquiring his loans. Now his answer is to sue the people and the municipalities that have tried to help him improve the property and thats just a shame, and thats sad and disingenuous I think, said Clark Rich.

John Abbott, Deputy Superintendent of East Irondequoit Schools told 13WHAM News that he thinks people should be insulted, but not surprised by this move.

Congel attached a letter to the lawsuit that said he hoped there would be a greater appreciation of the circumstances that have delayed the project.

Congel blames the financial market and filed a lawsuit against his bank in April.
